The Judicial Examination System in Japan and South Korea

Abstract

The judicial examination system is the way to select legal talents. By investigating whether the candidates have the professional knowledge and ability to become judges, prosecutors or lawyers. It is the way to achieve the purpose of selecting legal talents. Japan and South Korea have also experienced many reforms in the judicial examination system. As neighbors, there have encountered the same problems and made similar changes in the process of judicial examination system reform. The reform process has taken reference from the U.S. Law school system and the establishment of a localized College of Law system. From my perspective, the modern judicial examination system in both countries can be divided into two stages, the old judicial examination stage before the establishment of the Law school and the new judicial examination stage after the establishment. In the following section, I will introduce the differences in the development of the judicial examinations and the system set up in Japan and Korea under the different stages and evaluate them respectively.
